When first determining the existence of the Bird-of-Prey that can fire while cloaked, Spock states they only have "a theory, which happens to supported by the facts". By strict definition, this is exactly what a theory is. Although the term has colloquially come to be used as "an educated guess", a theory is a conclusion that is best supported by the data available. While a theory can change or be completely falsified by new data contradicting its conclusions, reaching the point of calling something a theory demonstrates a high level of certainty by a scientifically literate person such as Spock. Instead, they play a cat and mouse game with Starfleet to gain time to gather more evidence.
