When Burwell comes to convince Benjamin to stay in the revolution after the death of Gabriel he mentions that his wife is expecting, as the story hasn't changed since the beginning as 1776, where the "slaved" militia member was serving between 6 months to 1 year since the announcement posted from Washington, there's no way by time the Battle of Cowpens in 1781 where Burwell's son would've been 3 weeks old when that battle was over.
