A professional thief would be aware that in significant cases, law enforcement agencies routinely request or subpoena positional data from all cell phones near a crime scene to see what users were in the vicinity. It shows not only who was there at what time, based on whose phones were pinging what towers and what WiFi connections were active, it allows them to track all those phones movements before and after as long as the phones remain active.By not carrying it on her person, the Catwoman's cell phone's position could be therefore be used to support her alibi, showing police that she was "home the whole night".Conversely, having it on her while she was in the Mayor's residence would potentially give police strong proof that she was somewhere she had no business being, and for how long, and where she went afterwards. It would lead investigators right to her door. Criminals routinely park their cell phones in innocuous locales for just that purpose, and throw police off their scent.
