The opening shot shows the Joker from behind, with his mask in his hand. As he had no time to put his make-up on, he already wears it. On a street, in broad daylight. As long as his not calling attention to himself no one would notice. If someone should notice him wearing clown make up, it doesn't constitute a crime, wouldn't be a threat to the public, and only assume he has psychological issues.
