When Marshal Cooper announces the 1 hour break, he states that anyone not back in their seat on the stroke of 5 is excluded from the game and forfeits their winnings. Bret Maverick appears in the window at the stroke of 5 and therefore was not in his seat so he should have been excluded from the remainder of the game.
