In the final scene, Sgt. Castle chases the art thief through the interior of the Sepulveda dam. As soon as he sees the the thief, who is unarmed and is simply running, Castle takes a shot at him. When the Sgt. finally corners the man, who is now just standing next to a railing at this point and is no physical threat to the officer, the officer just shoots him. This would be murder, as there was no justification to use deadly force at this point, especially against an elderly art thief.
