Desi was shown as a well to do man who would have a smart phone with him. Amy's supposed kidnapping could be tied to a certain date between certain times. Since her concocting Desi kidnapping her was not part of her original plan, she could not account for Desi's location on the date she was supposedly kidnapped. A police investigation would routinely use tracking of Desi's smart phone on the date he had supposedly kidnapped Amy. Since he was in fact far away at the time, he could easily have been eliminated as a suspect, which would then cast great doubt on her story and lead to charges against her. There would also exist any number of people that had seen him where he actually was that would have the same end result of excluding him.
