While rescuing Macey, Victoria has the evil genius at gunpoint. He is several meters away from her on the other side of a stretcher holding a scalpel. In the subsequent scene, he now has Victoria's gun. She apparently stood still and did not fire her gun while he came around the stretcher and disarmed her.
