The Klingon Ambassador (John Schuck) says at the hearing that Admiral Kirk test detonated the Genesis torpedo. Actually Khan did it by blowing up the USS Reliant and created a new planet. Which still is strange because it wasn't a dead moon or planet. Maybe that is why Genesis failed anyway not because Kirk's son David used protomatter!.
