Gordon tells his men not to inflict any physical punishment on the Joker, because he doesn't want to give his mob lawyer any reason to question their methods. He subsequently knowingly leaves him alone in an interrogation room with Batman. This is not necessarily a mistake since learning Dent never got home has changed the situation.
