When Dan leaves the police station, he still has the fake coke with him. When police confiscate "unknown" substances (including breath mints and cigarettes), they do not return them. They claim to "destroy" such items ("for their protection"), so the likelihood that Dan would have it returned to him is Hollywood invention.
