In the Astronomy tower, Dumbledore tells Draco "I'll make it easy for you", he pulls out his wand with the intent of disarming himself. Draco knocks the wand out of Dumbledore's hand, but the act is meaningless. Dumbledore was already prepared to die, meaning he was not afraid of death and the wand knew this truth. Draco never won the wand. The wand would never align itself with Draco because he was weak and a bully. This means the wand never aligned itself with Harry. It was not owned by Draco. It was still aligned with Dumbledore.
