At the end of Spectre, M states that Blofeld is being detained under the Special Measures act of 2001. The newspaper clipping in Bond's desk regarding Blofeld's imprisonment, states he is convicted via the Terrorism Act of 2000. There is no reason why Blofeld could not at first be detained under one Act and then charged with new charges under a different Act once evidence and proof had been collected.
