In the directors cut of the movie it is explained that Gary Figgis has changed his gun by picking up the Glock Jack Rucker dropped after being shot by Freddy Heflin. As they leave the house after the gun fight he drops the Glock back on the ground next to Rucker's body (presumably where he got it in the first place)
