In Aqua Dulce, the Pinkertons say they are looking for a fugitive from Colorado Territory. Colorado has been a state since 1876, approximately fifteen years before the setting of this film.In the late 1890s, Pinkertons were mostly thugs, bully-boys and strikebreakers, not the type who have any interest in political news, such a new states joining. There's a good chance they didn't even know or care.
