This confuses two different departments. The PTO (Patent and Trademark Office) deals only in Patents and Trademarks, while copyrights are issued by the Copyright Office. He should have said either "Call the Patent Office, I want to trademark that name," or "Call the Copyright Office, I want to copyright that name."
