When Gambini "rests" the defense's case, prosecutor Trotter makes a motion to dismiss all charges (which presumably is granted since the defendants are subsequently released). This never would have happened. The defense would never have rested their case but would've instead made a motion for Judgment of Acquittal since the evidence cannot prove the defendants' guilt.Further, even if the defense (through neglect or incompetence) failed to file the aforementioned motion, the prosecution would never have allowed the defense to rest their case but would have filed a motion to dismiss to prevent the case from going to the jury.
