When trying to build Nick's case, Tanner, a seemingly experienced and highly skilled lawyer who gets (presumably) guilty men off all the time on technicalities and lack of evidence, says it's useless to try to prove that Amy orchestrated the whole thing. However, he somehow does not manage to think of calling on the delivery people for Nick's "man cave" gifts as witnesses (who would have to have had someone let them into the shed, even if the shipping instructions said to go to the shed), looking into an alibi for Desi, calling on a medical examiner for Amy's injuries and alleged miscarriage or covertly bugging any part of their bathroom. Amy has also claimed that Desi Collings attempted suicide in her bed via an overdose, which likely would have required medical attention or at least something the boarding school authorities would have known about, so her claim could have easily been disproved. All this plus Tommy O'Hara's testimony would have made a compelling case to debunk Amy's claims and have Nick walk free.
