At the end of the trial, a reporter said the DA announced he would seek the death penalty. In fact, the DA would have had to serve notice prior to the trial that he was going to seek the death penalty and the jury would have had to been qualified for a death penalty case, i.e. jury members must agree they would return the verdict of death if they felt it was warranted.
